Terms of Service

 

Article 1 (Purpose)

The purpose of these Terms and Conditions is to stipulate the rights, duties, and responsibilities of the cyber mall and the user in using the Internet-related services (hereinafter referred to as "Services") provided by TP Zone Cyber Mall (hereinafter referred to as "Mall") operated by WeAfriends (hereinafter referred to as "Company"). These Terms and Conditions shall also apply to e-commerce transactions using PC communication, wireless, etc., unless contrary to their nature.

Article 2 (Definition)

① "Mall" refers to a virtual business site established by the company to provide goods or services (hereinafter referred to as "goods, etc.") to users and to trade goods, etc. using information and communication facilities such as computers, and is also used in the sense of a business operator operating a cyber mall.

② "User" refers to members and non-members who access the "Mall" and receive the services provided by the "Mall" in accordance with these Terms and Conditions.

③ 'Member' refers to a person who has registered as a member of the 'Mall' and can continue to use the services provided by the 'Mall'.

④ 'Non-member' refers to a person who uses the services provided by the 'Mall' without registering as a member.

 

Article 3 (Statement, Explanation, and Amendment of Terms and Conditions)

① The "Mall" shall post the contents of these Terms and Conditions, the name of the company and representative, the address of the business location (including the address of the place where consumer complaints can be handled), telephone number, e-mail address, business registration number, e-commerce business registration number, and personal information manager on the Mall so that users can easily recognize them. However, the contents of the Terms and Conditions may be made available to users through a connected screen.

② "Mall" shall seek confirmation from the user by providing a separate connection screen or pop-up screen so that the user can understand important contents such as withdrawal of subscription, delivery responsibility, and refund conditions among the contents stipulated in the Terms and Conditions before the user agrees to the Terms and Conditions.

③ The "Mall" may amend these Terms and Conditions to the extent that it does not violate the relevant laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-door Sales, etc.

④ If the "Mall" revises the Terms and Conditions, it shall specify the effective date and the reason for the revision and notify it on the initial screen of the Mall along with the current Terms and Conditions from 7 days before the effective date to the day before the effective date. However, if the contents of the terms and conditions are changed to the disadvantage of the user, at least a grace period shall be notified in advance. In this case, the "Mall" shall clearly compare the contents before the revision and the contents after the revision and display them for users to understand.

⑤ If the "Mall" revises the Terms and Conditions, the revised Terms and Conditions shall apply only to contracts concluded after the effective date, and the provisions of the Terms and Conditions before the revision shall apply to contracts already concluded before that date. However, if a user who has already concluded a contract sends a notice to the 'Mall' within the notice period of the revised terms pursuant to Paragraph 3 and receives the consent of the 'Mall', the provisions of the revised terms shall apply.

⑥ Matters not provided for in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce prescribed by the Fair Trade Commission, and related laws or practices.

Article 4 (Provision and Modification of Services)

① The "Mall" shall perform the following tasks: 1. providing information on goods or services and concluding a purchase contract 2. delivering goods or services for which a purchase contract has been concluded 3. other tasks prescribed by the "Mall"

② The "Mall" may change the contents of the goods or services to be provided under a contract to be concluded in the future, such as if the goods or services are out of stock or the technical specifications are changed. In this case, the contents of the changed goods or services and the date of provision shall be specified and immediately notified where the contents of the current goods or services are posted.

③ If the "Mall" changes the contents of the service contracted with the user to provide for reasons such as out of stock goods or changes in technical specifications, the reason shall be immediately notified to the user at the address where the user can be notified.

④ In the case of the preceding paragraph, the "Mall" shall compensate the user for any damages caused by this. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.

Article 5 (Suspension of Services)

① The "Mall" may temporarily suspend the provision of the service for reasons such as maintenance, inspection, replacement, breakdown of information and communication facilities such as computers, or interruption of communication.

② The 'Mall' shall compensate for any damages suffered by the user or a third party due to the temporary suspension of the provision of the service due to the reasons in Paragraph 1. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.

③ If the service cannot be provided for reasons such as switching business items, abandonment of business, or integration between companies, the "Mall" shall notify the user in the manner set forth in Article 8 and compensate the consumer in accordance with the conditions originally proposed by the "Mall". However, if the "Mall" does not notify the compensation criteria, the user's mileage or accumulated points shall be paid to the user in kind or in cash equivalent to the value of the currency used in the "Mall".

Article 6 (Membership)

① The user applies for membership by filling in the membership information according to the registration form prescribed by the "Mall" and indicating that he or she agrees to these Terms and Conditions.

② The "Mall" shall register users who apply for membership as described in Paragraph (1) as members unless they fall under any of the following items: 1. If the applicant has previously lost membership pursuant to Article 7, Paragraph 3 of these Terms and Conditions, except that if the applicant has obtained the consent of the "Mall" to rejoin membership after 3 years have elapsed since the loss of membership pursuant to Article 7, Paragraph 3. 2. if there are any falsehoods, omissions, or errors in the registration contents 3. if it is judged that registering as a member is significantly hindered by the technology of the 'Mall'

③ The time of establishment of the membership contract shall be the time when the consent of the 'Mall' reaches the member.

④ If there is a change in the information registered at the time of membership registration, the member shall notify the "Mall" of the change within a reasonable period of time by modifying the membership information.

Article 7 (Withdrawal of Membership and Disqualification)

①Members may request withdrawal from the "Mall" at any time, and the "Mall" shall immediately process the withdrawal.

②If a member falls under any of the following reasons, the "Mall" may restrict or suspend membership. 1. if the member registers false information when applying for membership 2. if the member fails to pay the price of goods purchased using the "Mall" or other debts incurred by the member in connection with the use of the "Mall" on the due date. 3. if the member threatens the order of e-commerce, such as by interfering with the use of the "Mall" by others or stealing information. 4. if the member uses the "Mall" to commit acts prohibited by laws, these terms and conditions, or contrary to public order and morals.

③ After the "Mall" restricts or suspends the membership, if the same act is repeated more than twice or the reason is not corrected within 30 days, the "Mall" may lose the membership.

④ If the "Mall" loses membership, the membership registration shall be canceled. In this case, the member shall be notified and given a period of at least 30 days to show cause before the membership registration is canceled.

Article 8 (Notification to Members)

① When the "Mall" makes a notice to a Member, it may be made to the e-mail address specified by the Member in advance by agreement with the "Mall".

② In the case of notification to an unspecified number of members, the "Mall" may substitute individual notification by posting it on the "Mall" bulletin board for more than one week. However, individual notifications shall be made for matters that have a significant impact on the member's transactions.

Article 9 (Purchase Application and Consent to Provide Personal Information)

① Users of the "Mall" shall apply for purchase by the following or similar methods on the "Mall", and the "Mall" shall provide each of the following contents in an easy-to-understand manner when the user applies for purchase. 1. search and selection of goods, etc. 2. input of the recipient's name, address, phone number, e-mail address (or mobile phone number), etc. 3. confirmation of the contents of the terms and conditions, services with a limited right of withdrawal, and costs such as shipping and installation fees 4. indication (e.g., a mouse click) to agree to these terms and conditions and confirm or deny the items in paragraph 3.1 above. 5. application for purchase of goods, etc., and confirmation or agreement to confirmation by the "Mall" 6. selection of payment method

② If the "Mall" needs to provide the buyer's personal information to a third party, it must notify the buyer of 1) the person to whom the personal information is provided, 2) the purpose of using the personal information of the person to whom the personal information is provided, 3) the items of personal information to be provided, and 4) the period of retention and use of personal information by the person to whom the personal information is provided, and obtain consent. (The same applies to changes in consent.)

③ If the "Mall" entrusts a third party to handle the personal information of the buyer, the "Mall" shall notify the buyer of 1) the person to whom the personal information is entrusted, 2) the contents of the task of entrusting the personal information, and obtain the buyer's consent. (The same applies if the consent is changed.) However, if it is necessary for the fulfillment of the contract for service provision and related to the convenience of the buyer, the notice and consent procedures may be waived by notifying through the privacy policy in the manner prescribed by the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.

Article 10 (Establishment of Contract)

① The "Mall" may not accept a purchase application as described in Article 9 if any of the following applies. However, in the case of concluding a contract with a minor, it shall be notified that the contract may be canceled by the minor or his or her legal representative if the consent of the legal representative is not obtained. 1. if there are any falsehoods, omissions, or errors in the application contents; 2. if the minor purchases goods and services prohibited by the Juvenile Protection Act, such as tobacco and alcohol; 3. if the "Mall" determines that approving the purchase application will significantly hinder the technology of the "Mall.

② The contract shall be deemed to have been concluded when the "Mall's" consent reaches the user in the form of a receipt confirmation notice under Article 12.1.

③ The "Mall's" intention to accept shall include information on the confirmation of the user's purchase application, the availability of the sale, and the cancellation of the correction of the purchase application.

Article 11 (Payment Method)

Payment for goods or services purchased from the "Mall" may be made by any of the following methods. However, the "Mall" may not add any nominal fees to the price of goods or services for the user's payment method.

1. various account transfers such as phone banking, internet banking, mail banking, etc.

2. card payments, including prepaid cards, debit cards, credit cards, etc.

3. Online bankbook deposit

4. Payment by electronic money

5. Payment upon receipt

6. Payment by points provided by the Mall, such as mileage, etc.

7. Payment by gift certificates contracted with the "Mall" or recognized by the "Mall"

8. payment by other electronic payment methods, etc.

Article 12 (Notification of Receipt, Change, and Cancellation of Purchase Application)

① The "Mall" shall provide a receipt confirmation notice to the user when the user applies for purchase.

② If there is a discrepancy in the user's expression of intent, the user may request to change or cancel the purchase application immediately after receiving the receipt confirmation notice, and the "Mall" shall process the request without delay if there is a request from the user before delivery. However, if the payment has already been made, the provisions of Article 15 on withdrawal of subscription, etc., shall apply.

Article 13 (Supply of Goods, etc.)

① Unless there is a separate agreement with the user regarding the timing of the supply of goods, etc., the "Mall" shall take other necessary measures such as customization, packaging, etc. so that the goods can be delivered within 7 days from the date the user makes a request. However, if the "Mall" has already received all or part of the payment for the goods, it shall take action within 3 business days from the date of receipt of all or part of the payment. At this time, the "Mall" shall take appropriate measures so that the user can check the procedure and progress of the supply of goods, etc.

② The "Mall" shall specify the means of delivery, the person who bears the delivery cost by means, and the delivery period by means for the goods purchased by the user. If the 'Mall' exceeds the contractual delivery period, the 'Mall' shall compensate the user for the resulting damages. However, this shall not apply if the 'Mall' proves that there was no intention or negligence.

Article 14 (Refund)

If the "Mall" is unable to deliver or provide the goods that the user has applied to purchase for reasons such as out of stock, the "Mall" shall notify the user of the reason without delay, and if the payment for the goods is received in advance, the "Mall" shall refund the payment or take necessary measures for refund within 3 business days from the date of receipt.

Article 15 (withdrawal of subscription, etc.)

① A user who has concluded a contract for the purchase of goods with the "Mall" may withdraw his or her subscription within 7 days from the date of receipt of a written document regarding the contents of the contract pursuant to Article 13, Paragraph 2 of the Act on Consumer Protection in Electronic Commerce (if the supply of goods, etc. is later than the date of receipt of the written document, it refers to the date on which the goods, etc. are supplied or the supply of goods, etc. begins). However, if the Act on Consumer Protection in Electronic Commerce, etc. provides otherwise regarding the withdrawal of a subscription, the provisions of the Act shall apply.

② When the user receives the goods, etc., the user shall not be entitled to return or exchange the goods if they fall under any of the following subparagraphs: 1. If the goods are lost or damaged due to reasons attributed to the user (however, if the packaging is damaged to check the contents of the goods, etc., the user may withdraw the subscription); 2. If the value of the goods is significantly reduced due to the user's use or partial consumption; 3. If the value of the goods is significantly reduced to the extent that it is difficult to resell due to the passage of time; 4. If the packaging of the original goods is damaged if it can be replicated with goods with the same performance.

③ In the case of Paragraph 2, Items 2 through 4, the user's right to withdraw the subscription shall not be restricted if the "Mall" has not taken measures such as specifying the fact that the withdrawal of the subscription is restricted in advance in a place where the consumer can easily recognize it or providing a trial product.

④ Notwithstanding the provisions of Paragraphs 1 and 2, if the contents of the goods, etc. are different from the contents of the display or advertisement or are performed differently from the contract, the user may withdraw the subscription within 3 months from the date of supplying the goods, etc. and within 30 days from the date of knowing or being able to know the fact.

Article 16 (Effect of withdrawal of subscription, etc.)

① If the "Mall" receives a return of goods, etc., from a user, it shall refund the price of goods, etc., already paid within 3 business days. In this case, if the "Mall" delays the refund of the goods to the user, the delayed interest calculated by multiplying the delayed interest rate set forth in Article 21.2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc. shall be paid for the delayed period.

② In refunding the above payment, if the user has paid for the goods or services by a payment method such as a credit card or electronic money, the "Mall" shall request the business that provided the payment method to suspend or cancel the charge for the goods or services without delay.

③ In the case of withdrawal of subscription, the user shall bear the cost of returning the supplied goods. The "Mall" shall not claim penalties or damages from the user for withdrawing the subscription. However, if the contents of the goods are different from the contents of the display or advertisement, or if the contract is performed differently, and the user withdraws the subscription, the cost of returning the goods shall be borne by the "Mall".

④ If the user bears the shipping cost when receiving the goods, etc., the "Mall" shall clearly indicate who bears the cost when withdrawing the subscription so that the user can easily understand.

Article 17 (Personal Information Protection)

① When collecting personal information from users, the "Mall" collects the minimum amount of personal information necessary to provide services.

② The "Mall" does not collect information necessary for the fulfillment of the purchase contract in advance when registering for membership; however, this shall not apply to cases where identification is required prior to the purchase contract in order to fulfill obligations under relevant laws and regulations and minimum specific personal information is collected.

③ The "Mall" shall notify the user of the purpose of collecting and using the user's personal information and obtain the user's consent.

④ The "Mall" shall not use the collected personal information for any purpose other than the purpose, and if a new purpose of use occurs or is provided to a third party, the purpose shall be notified to the user at the use and provision stage and consent shall be obtained. However, exceptions shall be made in cases where the relevant laws and regulations stipulate otherwise.

⑤ If the "Mall" is required to obtain the user's consent under Paragraphs 2 and 3, it shall specify or notify in advance the matters stipulated in Article 22, Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, such as the identity of the person in charge of personal information management (affiliation, name and phone number, and other contact information), the purpose of collecting and using the information, and the matters related to the provision of information to third parties (recipient, purpose of provision, and content of information to be provided), and the user may withdraw this consent at any time.

⑥ Users may request to view and correct errors in their personal information held by the 'Mall' at any time, and the 'Mall' shall be obligated to take necessary measures without delay. If the user requests the correction of an error, the "Mall" shall not use the personal information until the error is corrected.

⑦ The "Mall" shall limit the number of persons handling the user's personal information to a minimum in order to protect personal information and shall be responsible for all damages caused by the loss, theft, leakage, provision to a third party without consent, falsification, etc. of the user's personal information, including credit card, bank account, etc.

⑧ The "Mall" or a third party who has received personal information from the "Mall" shall destroy the personal information without delay when the purpose of collecting the personal information or the purpose of receiving the personal information is achieved.

⑨ The "Mall" does not set the consent field for the collection, use, and provision of personal information to be selected in advance. In addition, the "Mall" specifically specifies the services that are restricted when the user refuses to consent to the collection, use, and provision of personal information and does not restrict or refuse to provide services such as membership for the reason that the user refuses to consent to the collection, use, and provision of personal information that is not a mandatory collection item.

Article 18 (Obligations of the "Mall")

① The "Mall" shall not engage in any acts prohibited by laws and regulations or contrary to public order and morals and shall do its best to provide goods and services continuously and stably in accordance with these Terms and Conditions.

② The "Mall" shall have a security system to protect users' personal information (including credit information) so that users can use the Internet service safely.

③ The "Mall" shall be responsible for compensating users for damages caused by unfair display or advertisement of goods or services pursuant to Article 3 of the Act on Fairness of Display and Advertising.

④ The "Mall" does not send commercial e-mails for commercial purposes that the user does not want.

Article 19 (Obligations for Member's ID and Password)

① Except in the case of Article 17, the member shall be responsible for the management of his or her ID and password.

② The Member shall not allow any third party to use his or her ID and password.

③ If the Member realizes that his or her ID and password have been stolen or are being used by a third party, he or she shall immediately notify the 'Mall' and follow the instructions of the 'Mall'.

Article 20 (Obligations of Users)

The user shall not engage in the following acts

1. registering false information when applying or changing

2. stealing other people's information

3. altering information posted on the "Mall"

4. transmitting or posting information (computer programs, etc.) other than the information specified by the "Mall"

5. Infringement of intellectual property rights such as copyrights of the "Mall" and other third parties

6. Acts that damage the reputation or interfere with the business of the "Mall" or other third parties

7. disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the Mall.

Article 21 (Relationship between Connected "Mall" and Affiliated "Mall")

① If the parent "mall" and the child "mall" are connected by hyperlink (e.g., the object of the hyperlink includes text, pictures, and fairy tale statues), the former is called the connecting "mall" (website) and the latter is called the connected "mall" (website).

② If the connecting "mall" specifies on the initial screen of the connecting "mall" or on the pop-up screen at the time of connection that it is not responsible for the transaction with the user based on the goods provided by the connecting "mall" independently, it shall not be responsible for the warranty.

Article 22 (Attribution of Copyright and Restriction of Use)

① Copyright and other intellectual property rights for works created by the "Mall" shall belong to the "Mall".

② The user shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes or cause a third party to use the information obtained through the use of the "Mall" to which the intellectual property rights belong to the "Mall" without the prior consent of the "Mall".

③ The 'Mall' shall notify the user if it uses the copyright belonging to the user under the agreement.

Article 23 (Dispute Resolution)

① The "Mall" shall establish and operate a damage compensation mechanism to reflect legitimate opinions and complaints raised by users and to compensate for damages.

② The "Mall" shall prioritize the handling of complaints and opinions submitted by users. However, if it is difficult to process quickly, the user will be notified immediately of the reason and the processing schedule.

③ If a user applies for damage relief in connection with an e-commerce dispute between the "Mall" and the user, it may be subject to mediation by the Fair Trade Commission or a dispute mediation organization commissioned by the city or provincial governor.

Article 24 (Jurisdiction and Governing Law)

① Lawsuits regarding e-commerce disputes between the "Mall" and the user shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing, and if there is no address, the district court having jurisdiction over the residence. However, if the address or residence of the user is not clear at the time of filing or if the user is a foreign resident, it shall be filed with the competent court under the Civil Procedure Act.

② E-commerce litigation between the "Mall" and the user shall be governed by Korean law.
